1. Who we are
Prem123 (“we”, “us”) runs the game at prem123.com and the Prem123 and Are you a potato? accounts on social media. Contact us at hello@prem123.com. By using Prem123 you agree to these terms and to how we handle your data, set out in the privacy notice.
2. Who can play
You must be 18 or over. One account per person, in your own name or the name your mates know you by. Accounts are for people only: no bots, AI agents or automated sign-ups. We remove any we find.
3. Free, and never a bet
Prem123 is free. There are no stakes, entry fees, pots or prizes, and it is not gambling. Play for bragging rights only: don’t use a league to run bets between yourselves. We may close a league that is being used for betting.
4. The potato
Whoever finishes bottom of a league’s month is “the potato” and is dared to carry a potato for 24 hours and post the proof. It’s a dare, not a duty: nobody has to do it, and nothing in the game punishes anyone who doesn’t. If you do it, keep it safe, legal and sensible, especially at work or school. You are responsible for what you do, film and post.
5. Playing fairly
- Names and league names must not be offensive, hateful or pretend to be someone else.
- Don’t try to see hidden picks, pick after a lock, or break or overload the site.
- League admins can approve, remove and let back in players in their league.
- We may remove a name, a player or a league that breaks these terms.
6. Videos and photos you share with us
You keep ownership of anything you film or photograph. When you upload a video or photo to Prem123, send one to us (by message, email or our upload page at prem123.com/potato), or say yes when we ask to feature a post you tagged @areyouthepotato or #AreYouAPotato:
- you give us permission to use, edit, caption and post it on prem123.com and our social media accounts, including in videos that earn advertising money, worldwide and free of charge, credited to the name or handle you give us;
- you confirm you are 18 or over, you made it or have the right to share it, and everyone recognisable in it agreed to it being posted;
- you confirm it contains no club crests, match footage or music you don’t have the rights to.
You can ask us to take it down at any time by emailing hello@prem123.com. We will remove it from our accounts within 14 days. We can’t recall copies other people have already shared. Sharing a post inside the same app with that app’s own buttons (a story share, a repost) doesn’t need this permission, because the app’s own terms cover it.
7. What’s ours
The Prem123 site, its design, words, code and our own photos and videos belong to us. PREM123 and Are you a potato? are our trade marks. Please don’t copy them or use them for your own product.
8. Football and results
Prem123 is not affiliated with, endorsed by or connected to the Premier League or any club. Club names are used only to say which match is which. Fixtures and results come from a third-party data feed and can be late or wrong; we may correct a result, and tables follow the corrected result. Kick-off times can change, and a pick locks 1 hour before the actual kick-off.
9. The service
We run Prem123 as a free game and may change, pause or end any part of it. We aim to keep it working and accurate but can’t promise it will always be available or error-free. We are not responsible for losses that come from using it, as far as the law allows. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or anything else the law doesn’t let us limit.
10. Changes and law
We may update these terms; the date at the top shows the latest version, and we will tell players by email about any big change. These terms are governed by the law of England and Wales. Questions to hello@prem123.com.
